On October 8, 2026, a federal judge in São Paulo issued a preliminary injunction permitting Stake Brazil to continue fixed-odds betting operations until October 25, 2026.

President Luiz Inácio Lula da Silva signed Provisional Measure No. 1,394/2026 on September 25, 2026. The measure ordered betting platforms to go offline within ten days and set the expiration of existing authorizations for thirty days after publication, ending on October 25, 2026.

Stake Brazil said that, to its knowledge, it is the first licensed operator in Brazil to obtain judicial protection against the federal online betting ban. The company has invested approximately 128.2 million Brazilian reals in its local operations, paid a 30 million real licensing fee, contributed 87.8 million reals in share capital, employs 41 workers in Brazil, and held 508,084 player wallets as of September 2026.

Stake Brazil must maintain open withdrawal processing and retain sufficient funds to cover outstanding player balances under the injunction. While the injunction is in effect, it prohibits Stake Brazil from launching new promotional campaigns, acquisition bonuses, or any marketing initiatives intended to expand its user base.

The injunction applies solely to Stake and does not suspend the broader federal ban on online betting, leaving other operators prohibited from operating. The court may alter or end the provisional order before October 25 if it receives further information from federal authorities or issues a subsequent ruling.

Following the injunction, Stake Brazil’s betting site (stake.bet.br) returned online on Thursday afternoon. The majority of other licensed betting sites remained offline after the ban took effect on October 6, 2026.

Brazil’s Attorney General’s Office has announced plans to appeal the injunction. The Supreme Federal Court has yet to rule on the constitutionality of the provisional measure.

Several international betting operators have exited the Brazilian market. Others have reduced their operations in anticipation of government enforcement or in hopes of a clearer licensing regime under forthcoming regulations.
